Legal advice please!
Jun. 30th, 2011 08:15 pmRight, well I will try not to fume too much, but in my usual monthly trawl of Etsy looking for beetle-related crafts (I love supporting other crafty folks who make beetly things!), I found this:

Could this in any way be related to a deliberately not-hi-res-scanned, all-rights-reserved photograph of a drawing of mine that I uploaded to Flickr last September?

IT SURELY COULD.
This really irks me. Not least because the picture isn't even centered in that ring! UGH! I've emailed Etsy to report copyright infringement (I have my own store and was intending to sell the original plus prints thereof there) and I have also politely asked the seller to withdraw the listing or to credit me as the owner of the original artwork. Anything else I could do? I still have the original drawing, which incidentally has been scanned for inclusion in a book of my beetle illustrations.
Thanks for any and all advice, I feel so naive :/
EDIT: I did just get a reply from the seller as follows "'m sorry I will remove it. I just found it online and thought it was a great image. My sincerest apologies." I'm willing to give the benefit of the doubt, as it's totally possible that someone else reposted it without credit and that's where the scan came from. But yeah, I think I learned a lesson there! I think I just expect everyone to be fair!
Edit: quickly fixed, lesson learned :/
